我國自貿試驗區數據出境負面清單制度分析與解讀

摘要： 隨著全球數字經濟的發展與世界跨國貿易規則的重塑，數據的國家安全屬性逐漸顯現，其跨國流動可能會對國家安全、公共利益帶來安全威脅。近年來，我國不斷探索能夠保障國家安全的數據出境管理辦法。2024年3月22日國家互聯網信息辦公室發布了《促進和規范數據跨境流動規定》，其中第六條要求建立國家自貿試驗區數據出境負面清單制度，這是我國在數據跨境流動安全監管方面的最新探索，其實施將為進一步細化我國數據跨境流動監管方案積累寶貴經驗。文章從數據出境負面清單基本內涵、負面清單制定的政策空間、自貿試驗區數據出境負面清單設計要點展開研究，并提出了對自貿試驗區負面清單制度的兩點認識。該研究將為我國各自貿試驗區開展本自貿試驗區數據出境負面清單的制定工作提供參考。

Analysis and interpretation of the negative list system for data export from China′s pilot free trade zones

Abstract： With the development of the global digital economy and the reshaping of global cross-border trade rules, the national security attributes of data are gradually emerging, and its cross-border flow may pose a security threat to national security and public interests. In recent years, China has continuously explored data export management methods that can ensure national security. On March 22, 2024, the State Internet Information Office released the Regulations on Promoting and Regulating the Cross border Flow of Data, in which Article 6 requires the establishment of a negative list system for the outbound data of the National Pilot Free Trade Zone. This is the latest exploration in the security supervision of cross-border data flow in China, and its implementation will accumulate valuable experience for further refining China′s cross-border data flow supervision scheme. This article conducts research on the basic connotation of the negative list for data export, the policy space for formulating the negative list, and the key points for designing the negative list for data export in free trade pilot zones. It also proposes two understandings of the negative list system for free trade pilot zones. This study will provide reference for the development of negative lists for data export in China′s respective free trade pilot zones.

引言
隨著全球數字經濟的發展，數據作為重要生產要素［1-2］，已經成為跨國貿易得以實現的前提條件與基礎保障，重塑著世界貿易規則，并對世界政治經濟格局產生了深刻的影響［3-4］。與此同時，海量數據的跨境流動給國家安全、公共利益帶來了安全威脅［5-6］。為保障數據安全和個人信息權益，進一步促進數據依法有序自由流動，2024年3月22日，國家互聯網信息辦公室發布了《促進和規范數據跨境流動規定》（以下簡稱《規定》）?！兑幎ā返诹鶙l建立了數據出境負面清單制度，提出自由貿易試驗區可以在國家數據分類分級保護制度框架下，自行制定區內需要納入管理范圍的數據出境負面清單。由于數據出境負面清單制度屬于制度創新，相關理論尚不完善，這導致各試驗區制定本試驗區數據出境負面清單的工作難以有效推進。本文將從數據自身性質、發展規律等方面展開研究，分析解讀我國自貿試驗區數據負面清單制度，為自貿試驗區制定、應用負面清單提供參考。
